Terms of Service

The service

Flickks lets you create photo and video albums, build a portfolio site with templates you can customize, share links (open or password-protected), invite collaborators where your plan allows, and optionally connect a custom domain. Features available to you depend on your plan.

Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use Flickks. You are responsible for your account credentials and for all activity under your account. Keep your password secure and tell us promptly if you suspect unauthorized access.

Your content

You retain ownership of the photos, videos, and other content you upload. By uploading content, you grant us a limited, worldwide, non-exclusive license to host, store, process, display, transmit, and distribute that content solely to operate and provide Flickks, including generating the pages and downloads you choose to publish or share.

You agree that you will not upload content that:

• Infringes someone else's copyright, trademark, or other rights
• Is unlawful, harassing, abusive, defamatory, or obscene
• Contains malware or attempts to disrupt the service
• Violates the privacy or publicity rights of others without permission

You represent that you have the rights needed to upload and publish your content, including model or property releases where required.

Publishing, passwords, and sharing

When you publish an album or portfolio page, that content becomes reachable at the URL you share. Password protection limits casual access; it is not a substitute for enterprise secrecy controls. You are responsible for deciding what to publish, who receives links or passwords, and whom you invite to collaborate.

Plans, billing, and storage

Free and paid plans include different storage, album, template, domain, and support limits. Paid subscriptions are billed through our payment provider (Dodo Payments). Prices and entitlements may change; we will give reasonable notice of material changes where required. Fees are generally non-refundable except where required by law or stated otherwise at checkout. If a subscription lapses or you exceed plan limits, we may restrict uploads, publishing, or other features until you upgrade or free space. Album collaboration requires an active Pro or Studio entitlement. When an account no longer has Pro-or-higher access, client microsites may be archived and taken offline while their settings and album assignments remain preserved. After 60 days without paid access, the main site and media may move to cold storage until the account resubscribes.

Acceptable use

You agree not to:

• Use Flickks for illegal purposes or to violate applicable laws
• Attempt to access another user's account or data without authorization
• Interfere with or disrupt the service, servers, or networks
• Scrape, reverse engineer, or misuse the platform except as permitted by law
• Resell Flickks as a white-label hosting product without our written permission
• Use automated means to create accounts or exhaust storage in a way that harms others

Our intellectual property

Flickks, our templates, branding, software, and documentation are owned by us or our licensors. These Terms do not grant you rights to copy, modify, or redistribute our templates or product outside normal use of the service, except as we expressly allow.

Service availability

We work to keep Flickks available and reliable, but the service is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue features at any time. We are not liable for downtime, data loss, or delays beyond what the law requires us to cover.

Termination

You may stop using Flickks and delete your account from Account at any time (email confirmation required), or request deletion by email. We may suspend or terminate your access if you violate these Terms, if required by law, or if we reasonably believe your use poses risk to the service or other users. Upon termination, your right to use the service ends; provisions that by nature should survive (including ownership, disclaimers, and limitations of liability) will survive.

Disclaimer of warranties

To the fullest extent permitted by law, Flickks is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, Flickks and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim or (b) fifty US dollars (US $50), except where liability cannot be limited by law.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page and may provide additional notice in the product or by email. Continued use of Flickks after changes take effect constitutes acceptance of the revised Terms.
